摘　　要：以往的犯罪论体系研究,是一种脱离犯罪论体系与刑法学其他重要范畴的关系而进行的孤立研究。犯罪论体系研究应是在照应其与刑法典的关系中进行。犯罪论体系是刑法典相关内容的理论整合,刑法典相关内容是犯罪论体系的实践素材。犯罪论体系并非完全被动地决定于刑法典,而是可以能动地反作用于刑法典,且能够集中体现刑法典的基本立场。犯罪论体系是一个将实体性与方法性、实践性与理论性融为一体的犯罪成立体系。犯罪论体系的建构不能无视刑法典的存在及其内容。照应其与刑法典的关系使得犯罪论体系研究也是一种关系型研究。在这种关系型研究中,刑法典构成了犯罪论体系的根基。The former research on the theoretical system of constitution of crime is isolated research because of separating the research from the relationship between the theoretical system of constitution of crime and other important categories of science of criminal law. The research on the theoretical system of constitution of crime should be in coordinate with the relationship between the theoretical system of constitution of crime and criminal code. The theoretical system of constitution of crime is the conformity of the relative contents of criminal code,while the relative contents of criminal code is the practical material. The theoretical system of constitution of crime is not passively decided by criminal code completely,while it can give counteraction on criminal code and embody the basic standingpiont of criminal code. The theoretical system of constitution of crime is the system of constitution of crime that makes substantivity and methodology,practicality and theoreticality mixed together. The construction of theoretical system of constitution of crime should not forget its own origins in the existence and relative contents of criminal code. To be coordinate with the relationship between the theoretical system of constitution of crime and criminal code can make the research on the theoretical system of constitution of crime and can also be relationship-styled research. In relationship-styled research,criminal code constitutes the foundation of the theoretical system of constitution of crime.
