论南海搜救活动中的船舶无害通过权

摘　　要：在南海搜救活动中,搜救船舶无害通过权的成立及行使关系到国际海上救援的进展速度,对在黄金救援时间内及时救助人命起着重要的作用。为此,应从理论上首先正面地确立搜救船舶的无害通过权,再以我国南海海域为视角,从南海救难舰本身的特殊属性、南海争议海域的存在以及南海诸国搜救合作的三个角度剖析出搜救船舶行使无害通过权的阻却性因素,最后从技术、立法、实践三个方面提出应对这些阻却性因素的思考。In the marine search and rescue of the South China Sea, the establishment and exercise of the fight of innocent passage for the ships relate to the pace of the international maritime rescue, playing an important role in saving lives in time within the golden window. Therefore, to begin with, it is supposed to positively establish the fight of innocent passage for the search and rescue ships in theory. Then the waters in the South China Sea should be taken as the perspective to analyze the resistance factors that hinder the fight of innocent passage for search and rescue vessels from the angels of the special properties of rescue vessels in the South China Sea, the existence of disputed waters in the South China Sea as well as the search and rescue cooperation among the countries around the South China Sea. Finally, some suggestions are put forward to cope with these resistance factors from the perspectives of technology, legislation and practice.
