摘　　要：海难行政救助是行政机关运用行政权实施的救助,其行为性质应根据海难救助发生的原因进行区分,分别定性为行政给付和行政强制。我国已经实施了富有成效的南海海域海难行政救助,但受救助类型、救助对象等因素的影响,其也存在着一些不足。在考虑南海海难行政救助影响因素的基础上,应从救助条件与程序以及报酬请求权等方面进行完善。此外,为了加强区域合作和提升救助效果,我国主管机关应积极推进南海海域海难行政救助的合作。The marine administrative salvage refers to the rescue that the administration applies political power to implement. Its nature should be distinguished according to the reasons for the occurrence of marine salvage, respectively defined as administrative supply and administrative enforcement. China has implemented the effective marine administrative salvage in the South China Sea waters, but some shortcomings also exist due to the effects of such factors as rescue types and objects. On the basis of the influencing factors of marine administrative salvage in the South China Sea, the rescue conditions and procedures as well as the right of claiming a reward should be improved. In addition, in order to strengthen the regional cooperation and promote the salvage effect, the administrative organs in China are supposed to actively promote the cooperation of marine administrative salvage in the South China Sea waters.
