消防责任事故罪主观方面分析

摘　　要：消防责任事故罪主观方面虽为过失,但行为人"经消防监督机构通知采取改正措施而拒绝执行"亦有"间接故意"之嫌。应将"拒绝执行"作为从重处罚情节,以促进单位积极落实消防安全主体责任,共建良好的社会消防安全环境。Although crime of fire obligation accident in the subjective aspect performance for negligence, actor ＂noticed by the fire supervision mechanism to take corrective measures but refused to execute＂ is also suspected of indirect intent. We should cons implement the main respons ider the ＂refused to execute＂ as the aggravating circumstances, so as to promote units to ibility actively and to build a good social circumstance of fire safety.
