江苏省水利工程建设征地补偿标准研究

摘　　要：征地补偿是水利建设工程移民安置的基础和重要内容,但是当前的法规政策在实际执行中存在诸多问题,亟需研究解决。运用土地产权理论和征收补偿理论,分析了江苏省水利工程征迁移民土地补偿标准,认为补偿标准体系不完善,导致各地标准差异,引起矛盾和冲突;江苏省政策和国家政策不一致,需要进一步完善。根据江苏省实际情况,提出了农村集体土地征收、国有土地征用及临时占地的具体补偿标准。Land requisition compensation is the basis and an important part for resettlement in water conservancy project construction,but there are many problems needed to be solved in the implementation of the current regulations and policies. We analyzed the land requisition compensation standard of water conservancy project in Jiangsu Province with the theory of land property rights and land requisition compensation and discovered that the standard is imperfect,which has caused many contradictions in different regions. In addition,the policies of Jiangsu Province are needed to be improved because they are inconsistent with the national policies. According to the actual situation in Jiangsu Province,we put forward a new specific compensation standard for the rural collective land requisition,state- owned land requisition and temporary occupation land.
