摘　　要：党的十八届三中全会作出的《中共中央关于全面深化改革若干重大问题的决定》对土地承包经营权作了制度革新,赋予农民更多的财产权利,使得他物权的征收既有法理上的支撑又有实践的需要。在理论上,土地所有权的征收已不能消灭土地上存在的作为独立用益物权的土地承包经营权。在实践中,土地征收制度框架下,农民土地承包经营权的补偿边缘化使失地农民成为最大的受害者。土地征收中所有权与他物权并征,在当下中国土地制度特有结构下,农民享有最大"红利",也是新物权观逻辑引发的必然。从立法上完善土地承包经营权独立物权地位,审慎规范土地征收制度,详实规定土地征收过程中补偿主体及细则,引入市场调节机制,才能最大限度保护农民的财产性权益。The Decision issued on The Third Plenary Session of the 18th Central Committee of the Communist made systematic revolution for the rights to contract and manage the land, it endows the farmer with more properties and rights, so that he imposed on both legal practice and support needs. Land acquisition and ownership right with his sign, under the current structure of China＇ s unique system of land, farmers will have the highest ＂dividend＂ is a new concept of property rights caused by the inevitable logic. Improve land contract management right from the legislative status of independent property rights, land expropriation system of prudential norms, detailed the main process of land expropriation and compensation rules, and to introduce the market regulating mechanism, to maximize the protection of farmers＇ property rights and interests.
