摘 要:我国"十三五"规划纲要,提出要"扩大民间资本进入银行业,发展普惠金融"。民间资本进入银行业,可以增加针对小额贷款的信息优势,同时减少小额信贷中的逆向选择和道德风险。但在准入制度、监管制度等方面法律供给的不足,成为民间资本进入银行业的障碍。明确民间资本进入银行业的资本准入路径与机构准入路径,有利于满足弱势群体的金融需求,从而促进普惠制金融体系的构建。The "13th Five-Year"plan proposed to expand the private capital into the banking, promote the development of Inclusive Finance. Although the entry for the private capital into the banking industry would has the information advantage of microfinance, and reduce the adverse selection and moral hazard in microfinance. But the shortage of supply of the legal system becomes an obstacle to hinder private capital into the banking industry. Therefore,it is necessary to develop the access rules for both capital and institution to meet the financial needs of vulnerable groups, and help to establish the inclusive financial system.
