鄂豫皖革命根据地法制建设研究述评

摘　　要：专门研究鄂豫皖革命根据地法制建设的论著迄今尚未得见,相关研究成果大致集中在四个方面:一是在鄂豫皖革命根据地史的专著中设专章或专节粗线条、定性式地从宏观层面研究法制建设,尤其聚焦其曲折性;二是研究鄂豫皖革命根据地政治保卫局等司法机关的设置与职能,独具特色和创造性的工农监察制度等司法制度;三是较为集中地研究鄂豫皖革命根据地的土地法、婚姻法和经济法等部门法的内容与历史作用;四是研究董必武和张国焘等人与鄂豫皖革命根据地法制建设的关系。学界需要加强对于法律文献的系统收集整理,从整体性角度加强对于发展阶段、特点、经验教训的研究;从近代以来中国法制现代化变迁、马克思主义法制观中国化、苏联法制建设经验移植、中共领导法制进程等角度开阔研究视野和拓宽研究领域,突破传统研究框架和研究路径,借鉴法学、政治学和社会学研究方法,把根据地法制建设研究引向具体化和实证化,把定性和定量、静止的法律条文与根据地波澜壮阔的发展进程相结合,清晰地展现法制建设的发生逻辑,分析法制建设的效果、不足与困境。Publications focusing on the legal construction in Hubei-Henan-Anhui revolutionary base area have not yet been seen. But the research achievements in this field roughly fall into four categories： macro research of the legal construction ; research of the setting and function of judicial organ and system; research of the contents and historical function of land law, marriage law and economic law; research of the relation between Dong Biwu, Zhang Guotao and legal construction. It is required to systematically collect and organize legal documents and to strengthen the research of developing phases, characteristics and experience and lessons. And the research view and field are needed to be broadened from the perspectives of the modernization of Chi- nese legal system, localization of Marxist concept of law in China, implantation of Soviet experience of legal construction and the development of legal system led by CPC. We need to break through the traditional re- searching framework and researching method, learn from the researching methods of law, politics and sociolo- gy, lead the research of the legal construction of Hubei-Henan-Anhui revolutionary base area to specification, combine the static legal documents with dynamic developing process, and clearly display the logic of legal construction as well as analyze the function, deficiency and difficulty of legal construction.
