摘　　要：本文系统研究了我国煤层气的产业运行规则,分析了执行中存在的四个主要问题,探讨了四个完善方向。1我国已经出台了数十部与煤层气开发利用有关的法律(法规)和国家行政管理文件,有力保障了产业的正常运转。2四个问题:一是包括煤炭法和土地法在内的法律(法规)不健全;二是部分产业扶持政策不完善、执行效果不理想;三是部分行政管理手段不到位、结果不理想;四是部分监管的手段与力度偏软。3四个完善方向是:一是需要修订煤炭法,需要土地管理部门支持煤层气开发的多种用地方式;二是需要调整开发补贴、所得税和增值税等产业扶持政策;三是需要完善与简化包括矿业权与行政审批在内的行政管理改革;四是需要加大包括矿业权、气价、财政补贴、对外合作和安全生产在内的监管体系建设。The operating rules for coalbed methane（CBM） industry in China are systematically studied in this paper,issues in four aspects are analyzed and four points for further improvement are proposed. It is indicated as follows. ① Dozens of laws, regulations and administrative documents related to CBM industry have been enacted to ensure the normal functioning of the industry. ②issues on four aspects .. a. the imperfect law,including Coal Law and Land Low; b. partially imperfect industrial supporting policy and undesirable results;c, partially unsatisfactory administrative management and undesirable results ld. partially inadequate supervision and lacking of regulation. ③ four points for further improvement： a. revise the Coal Law and support the land use of CBM development; b. revise and reset the industry financial supporting policy, including financial subsides,income tax and value added tax （VAT） for CBM development; c. simplify and improve administrative management for reform of mining rights and administrative approval procedures ld. improve the supervision system for mining rights, gas price, financial subsidy, foreign cooperation and security.
