摘 要:采矿权出让和采矿权价值评估法律制度使国家在国有矿产资源资产的配置中未能取得应有的矿产资源资产收益。规制矿产资源犯罪的刑事立法对盗采、破坏矿产资源的犯罪未能形成有效的威慑。国有矿产资源资产惨遭资源腐败利益共同体的掠夺而国有矿产资源资产监管法律制度未能起到应用的作用。为了防范国有矿产资源资产流失,应构建矿产所有权出让、矿产所有权价值评估的法律制度,构建矿产所有权出让金的数学模型,确定矿产所有权出让金的合理金额,完善国有矿产资源保护的刑事立法以及国有矿产资源资产监管的法律制度。The legal system of remising mining right and the value assessment of mining right cannot ensure that thestate can get the due income of mineral resource assets in the distribution of state-owned mineral resource assets.Criminal legislations regulating mineral crime are ineffective in deterring mineral crimes of illegal mining and destructionof mineral resources. The state-owned mineral resource assets have been robbed by interest community of resourcecorruption while legal system of assets supervision on state-owned mineral resources failed to have the effect ofapplication. To prevent the loss of state-owned mineral resource assets, the paper suggests the legal system of remisingthe ownership of mineral and value assessment of the ownership of mineral be constructed, mathematical model oftransfer fees of mineral ownership be set up, reasonable amount of money of mineral ownership be determined, criminallegislation in protecting the loss of state-owned mineral resource assets and legal system for regulating state-ownedmineral resource assets be improved.
