论农村地区的环保行政执法主体——以秦岭北麓西安段为例  

On the Subject of Administrative Law Enforcement of Environmental Protection in the Rural Area——Taking Xi'an Region of North Foot of Qinling Mountain as an Example

摘  要:不同农村地区所担负的不同功能决定生态在该地区的地位,进而决定环保行政执法主体在不同农村地区的差异。秦岭北麓西安段是典型的生态功能优先型农村,这表明环保行政执法主体在该段与在一般农村的不同。秦岭北麓西安段现行环保行政执法主体存在多头领导和职责交叉问题;执法人员素质亟待提高;对执法主体缺乏有效监督。应当科学设置环保行政执法主体,建立秦岭北麓管理区;建立高素质的环保行政执法队伍;建立统一的行政执法主体监督体制,加强对行政执法主体的监督。The different functions of different rural areas determines the ecological position of certain region, which as a result determines the different subject of administrative law enforcement of environmental protection in different rural areas. Ecological function in Xi'an region of north foot of Qinling Mountain determines that this re-gion is in a typically privileged position and demands a different subject of administrative law enforcement of envi-ronmental protection in this rural area. Current subject of administrative law enforcement of environmental protec-tion in Xi'an region of north foot of Qinling has more than one leading authority and has cross-duties. Enforcing staff's quality needs improvement. Enforcing subject has no effective supervision body. A subject of administrative law enforcement of environmental protection, managing department, shall be set up. A high -quality enforcing staff needs to be organized. A unitary supervision system, which will have the subject of administrative law en-forcement under strict supervision, shall be created.
