摘 要:当前,我国正开展新一轮深化科技体制改革,强调科技创新驱动经济社会发展。然而,我国高新科技领域立法缺乏对高新科技风险的理性认识,演化为控制过严与过度的立法滞后性,主要表现为缺少对高新科技的原则性规定、一些部门规章过于保守、未严格区分"科学"与"技术"等。因此,应当改弦易辙,深入认识并合理控制风险,创新立法思路,强调立法控制高新科技的风险,使高新科技合乎社会时宜,并区分"科学研究"与"技术开发"。At present,China is carrying on the new round of deepening reform of science and technology system,which emphasized on the social development by the scientific and technological innovation driving.However,for the lack of rational knowledge of the risk of high and new technology,Chinese legislation has the lags of the new science and technology progress,which has been excessive controlled and reminded too strict.This is mainly manifested as lack of legitimacy of high and new science and technology itself,the relevant department regulation is too conservative,and do not strictly distinguish between "science" and "technology".Correspondingly,We should change tack,try to get deeper understanding and reasonable control of risk in order to innovate legislation.That is,we should emphasize legislation to control the risk of high technology,and the high technology should be conformed to the social occasion,and distinct between "scientific research" and "technology development".
