摘　　要：许可使用费是专利权价值的体现,是专利权侵权损害赔偿额确定的依据。我国专利侵权案件中,以许可使用费确定赔偿额的方法未能得到充分和科学的适用。文章分析了我国司法实践中适用该方法存在的问题以及立法存在的缺陷,提出改进与完善的思路。Royalties are the reflection of the value of patent and the basis for the patent infringement damages. Chinese courts seldom use royalties to decide damages in patent cases. This paper analyses the problems of Chinese judicial practice and the defects of the relevant legislation as to applying royalties to decide damages. The paper also proposes the improving suggestions.
