摘　　要：农村房屋拆迁加速发展的过程中,基于公平正义理念应该给予作为弱势群体的农村老年人特殊优待。但是在现实房屋拆迁过程中,由于保护农村老年人权益的法律体系不健全、法律实施效果不佳等因素使得农村老年人权益在房屋拆迁过程中受到了忽视。因而需要通过健全法律体系、完善法律实施程序、明确拆迁主体、完善对拆迁过程中的监督体系等措施来保障拆迁前、拆迁中、拆迁后农村老年人合法利益。The process of rural housing demolition is speeding,based on the concept of fairness and justice should give preferential treatment to the rural elderly vulnerable groups. But in reality because of the legal system to protect the elderly is not perfect,the ineffective of legal is not good make the rights and interests of the elderly in rural areas in the process of house demolition have been neglected. So we need through a sound legal system,improve the legal implementation of the program,determine demolition of the subject,perfect the monitoring system of demolition process and through other measures to ensure the rural elderly legitimate interests.
