摘　　要：本文通过分析先占制度的历史、性质以及构成要件,阐释正是因为我国缺少这一制度,才导致了实践中出现很多难以解决的问题。尤其是伴随着我国改革开放的进一步深化和市场经济的飞速发展,先占越来越成为法律中不可或缺的重要内容。本文认为,我国需要在未来设置先占制度,以更好地维护先占人利益,实现物品价值,促进社会稳定并促进循环经济的发展。On the basis of looking into the legal nature,history and components of first holder ownership system,this paper argues that it is the absence of this system that leads to many unsolvable problems. With the development of reform,opening-up and market economy of China,first holder＇s ownership system has become an indispensable component of legislative system. China should legitimize this system to protect the holder＇s rights,to utilize the value of the property and to facilitate the stability of the society and the growth of cyclic economy.
