公众参与性司法化解“金融风险型”社会矛盾的路径探析

摘　　要：金融交易活动中存在的高风险,是激化掩盖于"利润暴力"下各种社会矛盾的主要诱因。当前利益主体多元化的社会形态,使传统意义上国家本位的社会矛盾司法化解机制无法应对来自不同群体的利益诉求和权利主张。甚至,由于其过于强调社会稳定而容易忽略公平和正义,有进一步引发社会危机的可能。以社会本位为基础的公众参与性司法化解机制,有机整合了各个方面的社会力量,形成了多元的矛盾化解路径,有助于寻求社会共同体的和谐相处和权益的集体认同,在保证社会稳定发展的同时实现矛盾的妥善解决。The high risks of financial transactions are the main cause that intensifies various social problems masked under ＂profit violence＂. Because of the diversification of interests, the judicial resolution mechanism of social contradictions based on state standard in a traditional sense cannot cope with the demands and claims of different social segments. Emphasizing social stability instead of fairness and justice can cause social crisis. Public participation judicial mechanism based on social standards can effectively coordinate resources from all aspects of society, construct nmnifold ways of resolving contradictions, and facilitate the pursuit of social harmony collective recognition of rights, to realize proper settlement of conflicts while ensuring stable development of society.
