摘 要:农地是农民最基本的生活保障,根据法律规定,农村的土地属于集体所有,农民对农地享有使用权,但不得抵押融资,这在一定程度上抹杀了农地的财产性,阻碍了农村金融的发展。通过修改与农地抵押相关的法律法规并建立农地抵押登记、价值评估及农地抵押风险控制等制度,允许农民对农地享有抵押的权利,拓宽农民融资渠道,发挥农地作为用益物权的价值。.Farmland is a basic guarantee for farmers' life. Since in accordance with relevant laws in China farmland is collectively owned and farmers only have the right to use farmland, they cannot mortgage the land to obtain financing, which, to some extent, obliterates the property characteristic of farmland and impedes the development of rural finance. Therefore, it is necessary to amend laws and regulations related to farmland mortgage, establish systems of farmland mortgage registration, value evaluation, risk control and the like, endow farmers with right to mortgage farmland, widen financing channels, and give full play to farmland's value of usufruct.
