上海推行环境污染责任保险的障碍与路径分析

摘　　要：阐述了国外环境污染责任保险的主要历程与经验以及国内的试点进程和效果。分析了上海市环境污染责任保险的现状及障碍,包括商业性环境污染责任保险、法制政策、技术及市场障碍。提出了上海市推行环境污染责任保险的路径：明确纳保企业范围、强化政策引导激励、建立相关技术体系。In respect of environmental liability insurance, main overseas progress and experience as well as domestic pilot process and effectiveness in China were presented. The status quo and obstacles of environmental liability insurance in Shanghai were analysed including commercial insurance, legal policies, technical and market obstacles. It has therefore been proposed that an approach to implementing environmental liability insurance in Shanghai should be to define the scope of enterprises covering the insurance, to strengthen policy-leading encouragement and to set up relevant technical system.
