上级检察院领导与下级检察院依法独立办案关系研究

摘　　要：文章以党的十八大报告确立的"推动省以下地方法院、检察院人财物统一管理"这一司法体制改革的基本目标为出发点,通过对检察一体原则进行重新解读和对目前检察机关上下级领导关系进行审视,力图在"人财物省级以下统管"背景下,给出优化检察机关上下级领导关系的合理化建议。通过分析,认为未来检察机关内部权力过度集中于上级检察机关、基层检察机关过于式微,是上下级检察机关关系健康发展的主要隐患,因而在机制设置上,应突出基层检察机关和检察官的主体性,明确检察官的客观义务,根据检察机关内部各部门自身司法或行政属性的强弱,实行分类管理。The Party＇ s eighteenth report has established the goal of promoting unified management of court and procuratorate below the provincial level. This article expounds around the goal, and through reinterpretating of procuratorial integration principle and scanning the leadership relations between the superior and the subordinate procuratorate, then attempts to give some reasonable suggestions which can optimize the leadership relations under the background of unified management below the provincial level. The main hidden danger of sound development of the leadership relations is the trend that the internal power may excessively concentrates in the superior procuratorial organs, while the subordinate procuratorate declines too much. Therefore we should design the institution that can extrude the subjectivity of grassroots procuratorate and prosecutors, specify the objective obligation of prosecutors, and manage different inner department on its merits such as judicial or administrative nature.
