摘　　要：通过现实案例比较,对医疗过失犯罪中医师之医疗行为及其注意义务予以理论分析。医疗组织分工之外的单个医师之注意义务,即单个医师所要履行的注意义务,具体为说明义务、亲自诊查义务、转诊时之注意义务。违反说明义务之行为在刑法意义之构成界定上存在争议。亲自诊查义务在现实状态中实存操作上的困难性。在医疗过失认定中,转诊义务与转诊时之注意义务两者存在内涵差别。医疗组织分工中的医师注意义务不再是涉及单个医师之注意义务,而是指在医疗组织分工过程中的医疗行为之注意义务,譬如监督义务、服从指示义务以及组织协调义务。By comparing actual cases of medical malpractice, it is analyzed about the relationship between medical behavior and care obligations with three sections. The first section is about the medical behavior. The second section is about the care obligations of medical behaviors that, in the basis of the crimes, are an objective criminal behavior like the bodily i identification criterion of the the medical level with other objective care obligation supplementation.
