摘　　要：由于艾滋病病情的特殊性,社会对艾滋病人的歧视,相关法律制度不完善,监管制度缺失,犯罪后的收押场所缺乏,打击力度不够,使得我国基层政府相关职能部门在管控艾滋病人犯罪时遇到很大困难,导致艾滋病人犯罪不断增多,严重影响公共安全与社会稳定。为此,可以借鉴国外在艾滋病人管控方面的先进经验,在实践中不断完善我国艾滋病人管控体系及社会保障机制,设立专门的羁押场所,加强对基层管控人员的业务培训,做到既充分保障艾滋病人应当享有的权利,又最大限度地预防和减少艾滋病人犯罪行为的发生。Due to the special nature of the AIDS disease, the current relevant functional departments of local governments encounter big difficult when they are controlling AIDS patients＇ crimes, which results in the increasing crime rate of HIV sufferers, and seriously affecting the public safety and social stability. Therefore, we can learn from the advanced experience of foreign countries in terms of management and control of AIDS patients, to improve our management and control system of AIDS patients, so that we can not only fully protect the rights of AIDS patients but also prevente and reduce the AIDS patients＇ crime rate maximumly.
