摘　　要：本文通过追溯帮助侵权行为法律沿革,剖析帮助侵权行为要素,以阐明网络服务提供商(ISP)的网络版权责任相关法理依据,并提出修订网络版权法律规定相关思考:落实帮助侵权法律依据,增加"避风港"条款对网络中介与网络用户关联度调查要求。This paper traces the history of contributory infringement and analyzes elements of contributory infringement to explain the theory of internet copyright liability.It provides ideas that will help revise rules concerning Internet copyrightby giving the legal basis of contributory infringement and addingthe survey of the relationship betweenInternet Service Provider and subscribers in the clause of Safe Harbors.
