渐进式延迟退休立法探究

摘　　要：人口老龄化日益严峻,基本养老保险基金的支付压力成为我国社会保障体制中遇到的最棘手的问题。现阶段,渐进式延迟退休成为最佳应对方法之一。但在立法过程中遭遇各类劳动者之间权利平衡的问题。因此,法律规制的制定应坚持保障人权、追求实质正义、允许合理差别。在程序上,通过小步徐趋的方式有条不紊地推进;在立法内容上,寻找各种劳动者权利关系之间的平衡点,确保切实可行。With the ageing population becoming more and more serious,the pressure of paying basic endow-ment insurance becomes the most thorny problem of China＇s social security system. At present,delaying retirement step by step is one of the best ways to deal with it. But in the process of legislation of delaying retirement is meeting difficulty. The difficulty is howto keep various workers＇ right balance. So legislation shall protect human rights,search for essential justice and allowrelatively reasonable difference. On one hand,legislation shall proceed in a planned way; on the other hand,the legislation shall find a balance between the rights of different laborers to ensure success.
