摘　　要：土地承包经营权是从农村集体所有权中分离出来的用益物权,土地承包经营权制度设计除了发挥土地物尽其用的作用之外,还内含着促进农民集体成员平等发展、共同富裕的集体属性。农民专业合作社的制度设计在于通过互助合作提高农户参与市场经济的能力。在追求土地适度规模经营效应的时代需求下,基于土地承包经营权制度设计与农民专业合作社价值取向上的契合性,应支持土地承包经营权流转至农民专业合作社。Land contractual management right is one kind of usufructuary right which comes from rural collective land ownership.Except pursuing for good account of land resource, it also includes the aim to promote common development and wealthy of farmers.The goal of the farmers＇ specialized cooperative is to enhance the farmers＇ ability involved in market economic.It is the trend for proper scale management about agriculture land.The value orientation is fit for land contractual management right as shares engaged in the farmers＇ specialized cooperative, so that it should be as the important choice for land contractual management right transfer.
