中国双边投资保护协定的发展和对比研究

摘　　要：不断发展与完善双边投资保护协定的条款与内容,主要目的是通过扩展、保护投资者的利益,完善国内司法救济、减少投资争议并与国际仲裁协调,从而扩大、促进国际投资。近年来,经济全球化和频繁的国际投资活动促使双边、多边及区域性的投资协议的激增。随着外资投资中国以及中国投资海外的不断深入和扩展,中国双边投资保护协定数量激增。对中国双边投资保护协定的定义条款、保护及待遇条款、国际仲裁条款、保护伞条款以及征收与补偿条款的演变和发展的分析表明,中国应尽快制定自己的投资保护协定范本,适应国际投资发展趋势,提高中国海外投资利益的保护水平。The constant improvement of the bilateral investment protection treaties aims to increase and protect the interest of the inves- tors, improve the domestic legal aid, and reduce investment disputes through international arbitration for promoting more international investment. In recent years, the economic globalization and frequent international investments have produced much more bilateral, multilateral and regional investment protection treaties. With more China＇s investment abroad and more internal investment in China, there have been more bilateral investment protection treaties. The historical analysis of the various terms in the existing investment pro- tection treaties of China leads to the conclusion that China should quickly work out a model of its investment protection treaties in order to satisfy the needs of international investment and protect its overseas investment.
