摘 要:通过回顾国内外标准化组织的专利信息披露政策,并结合我国专利默示许可的司法实践和专利立法,分析了成立专利默示许可的制度逻辑。只有在标准化组织有专利信息披露的要求,而标准参与者未在合理期间内披露其拥有的专利或专利申请信息,才应当适用默示许可。不过,专利默示许可适用的标准类型不应局限于国家标准,也不应局限于强制性标准。标准涉及的专利默示许可原则上应当允许专利权人收取低于正常情形的许可使用费,如果双方当事人就许可使用费协商不成时,应当直接交由法院而不是行政机关裁决。By reviewing the patent information disclosure policy of domestic and international standardization organizations, and taking into consideration of the judicial practices and patent legislation concerning implied license in China, the paper analyzes the institutional logic for the establishment of patent implied license. Only when standardization organizations require the patent information disclosure, while the standard participants do not disclose information about their patents or patent applications within a reasonable period, should the implied license be applied The applicable scope of the patent inplied license system, however, should neither be limited to the national standard nor the coir^ulsoiy standards. The patent inqjlied license involved in the standard should allow the patentee charge a licensing fee that is lower lhan 仕 le normal, but if there is no agreement upon the negotiations, the license fees shall be decided by the court rather than the administrative organ.
