精准扶贫视角下的我国农业保险扶贫困境与法律保障机制完善

摘　　要：充分发挥农业保险的化解农业风险、稳定农民收入、防控农民因灾致贫与返贫、保障国家粮食安全战略等基本功能,是推进我国农村精准扶贫精准脱贫和全面建成小康社会战略实施的内在需求。从精准扶贫视角来看,我国农业保险扶贫还存在扶贫对象识别不精准、项目安排不精准、保险补贴不精准与扶贫到户措施不精准等问题。法律是农业保险扶贫的基本保障。我国农业保险扶贫法律制度不完善是造成上述问题的重要原因。因此,我国应通过革新指导理念,健全立法保障体系,准确定性农业保险、合理配置农民保险权利、构建扶贫激励约束法律制度、优化农业保险风险防控法律制度等推进农业保险扶贫法律制度完善,以促进农业保险精准扶贫功能发挥,有效推进精准扶贫精准脱贫国家战略实施。It is internal demand to implementation of poverty reduction strategies of China＇s rural poverty alleviation accurate precision for give full play to resolve agricultural insurance agricultural risks,stabilize farmers＇ income,control of natural calamities farmers back into poverty,ensured national food security strategy and other functions. From the perspective of poverty accurate,China＇s agricultural insurance poverty also existed object such as not accurate recognition,not accurate project schedule,not precisely insurance subsidies measures,not poor households and other difficulties. Law is the basic guarantee to agricultural insurance of poverty alleviation. It is one of the important reasons that China＇s agricultural insurance legal system is not perfect for it. Therefore,our country should promote agricultural insurance precise poverty strategy through innovative guiding philosophy,sound legislation to protect the system,accurate characterization of agricultural insurance,rational design of farmers insurance rights,construct poverty incentive legal system etc.
