数字时代公共图书馆合理使用制度——《公共图书馆法(征求意见稿)》的完善

摘　　要：为了促使图书馆实现其公益性文化功能,法律授予非营利图书馆不经著作权人或相关权人许可、不支付费用使用他人作品的权利。我国《著作权法》给图书馆设定了有限的合理使用形式,也允许公共图书馆法进行特别规定。《公共图书馆法(征求意见稿)》第二十六条及第三十一条不能满足数字时代公共图书馆实现其功能的需求。综合考虑时代需求、法律依据、利益平衡与国际环境,《公共图书馆法》宜具体规定公共图书馆保存、信息网络传输、馆际互借、破解技术保护措施、排除限制性合同及责任豁免规则。For promoting non-profit library to accomplish it＇s cultural function, the law grants public library a right to free use copyrighted works without copyright owner＇s consent. China＇s Copyright Law granted library limited right of fair use, but also permitted public library law to make specific regulation. Article 26 and article 31 in Public Library Law （ Exposure Draft ） can not meet the requirements of public library in digital era. Considering demand of the times, basis for legislation, balance of interests, and international circumstance, Public Library Law should set specific provisions on preservation, distribution by internet, inter-library lending, circumvention of technological measures, excluding restrictive contract and exemption of liability.
