摘　　要：婚姻中的无效与撤销制度在制度价值、权利主体、法律效果、行使方式等方面具有特殊性,我国婚姻法对这些特殊性重视不足,应予以完善:无行为能力人结婚的,无效;错误的婚姻,无效或可撤销;对无正当理由违反婚约者,无辜方可主张精神损害赔偿;婚姻之无效,应仅发生向后无效之效果。The systems of void and revoke in marriage law have specialities in the value of system, subject of right, legal effects and the ways of exert right and so on. These specialities have not been given sufficient concern in China＇ s marriage law, which should be amended in the future. Person under a legal disability＇s marriage is null; significant misunderstanding marriage should be null or irrevocable; innocent party may claim compensation for spiritual damage; nullity of marriage has no retroactive effect.
