行政复议制度改革的地方实践和立法建议——基于《行政诉讼法》修改对行政复议制度的影响

摘　　要：我国行政复议制度长久以来存在诸多问题,新修改《行政诉讼法》的施行对行政复议制度又产生了明显影响,复议体制机制存在的问题和不足亟待改进。山东省遵循行政复议工作规律进行了系列大胆探索,总结了一套相对成熟的改革经验。当前应加快行政复议修法进程,重构行政复议制度体系,将集中复议权改革成果及时固化,确定复议、诉讼并行选择机制,围绕复议决定建构起严格科学的司法审理规则。There have been many problems in China＇s administrative reconsideration system for a long time,whilst significant effect on administrative reconsideration is brought by the implementation of the newly revised Administrative Procedure Law.Therefore,problems and deficiencies in related system need to be improved immediately.Following administrative reconsideration rules,a series of exploration has been done by the Shandong government,summarizing a set of relatively mature reform experience.Nowadays,the administrative reconsideration amendment procedure should be speed up,the related system should be reconstructed,the reform result of reconsideration right concentration should be solidified timely,and the system of reconsideration,litigation parallel selection should be defined,as well as strict and scientific judicial review rules of reconsideration decisions should be built up.
