对波斯纳和法律经济分析的一个争辩式解读——兼与林立先生商榷

摘　　要：林立先生的《波斯纳与法律经济分析》是目前华语世界唯一一部系统研究波斯纳的理论著作。然而,由于林书没有恰当地界定理性人假设和效率标准,也没有认识到波斯纳所追求的是社会成本视角下的机会平等而非分配正义,是潜在的帕累托而非实际上的帕累托改进,从而全书作为一个批判性的探究并不成功,没有完成推翻财富最大化的既定目标。而林立先生将罗尔斯的正义理论作为替代性选择,在理论上没有实质的进步,而在操作性上却是一种倒退。鉴于波斯纳秉持实用主义而非本质主义的立场,这使得目前类似林立先生的观点没有真正超越波斯纳。Richard A. Posner ＆Law and Economics written by Prof. Lin Li is the only theoretical writing which studies Posner＇s theory in Chinese-speaking world. However, Lin＇s book does not properly define the hypothesis of rational man and efficiency standards and does not recognize that what Posner chases for is the equality of opportunity in the perspective of social cost instead of distributive justice, which is a potential Pareto improvement instead of Pareto improvement in practice. Therefore, Lin＇s book as a critical inquiry does not succeed and does not complete the goad of overthrow wealth maximization. Prof. Lin Li chooses Rawls as an alternative option, and there is no substantial progress in theory. But in the operation it is a kind of regression. In view of the position of Posner＇s pragmatism instead of essentialism, this makes the current view of Prof. Lin not really go beyond Posner.
