摘 要:影视作品著作权转让具有其特性。制片人或者作者可以将传播权(或者公开再现权、表演权)转让给影院放映商,将作品的发行权和复制权转让或者许可给音像制品制造商,抑或是向广播电视台转让或者许可作品传播权。不同的影视公司之间也可能因为联合制片等原因共同拥有影视作品著作权或者需要从其他公司那里购买版权以成为影视作品的独家使用人。由于法律规定不明、争论不休,使得影视作品著作权转让纠纷不断。The copyright transfer of film and television products has its characteristics.Filmmakers or authors can transfer the spread rights(or public reproduction rights,performance rights) to cinema exhibitors,transfer or license the distribution rights and the right to copy to audio and video products manufacturers, or transfer or license the spread rights to the broadcast television station. Different television companies may own the copyright of the products as co-producers or need to buy the copyright from the other company to become the exclusive user of the film and television products. Since the law is unknown and being debated, there are always disputes in the copyright transfer of film and television products.
