摘　　要：在司法实践中,林地承包经营权并非如学界所讨论的均"可以继承"。法官对林地承包经营权继承的态度并非泾渭分明,往往取决于法官对经营权主体、继承主体、林地承包经营权性质的不同解读。同案不同判现象背后的原因是立法不明确甚至相互冲突,无法为司法实践提供有益的指导。因此,必须完善立法,明晰林地承包经营权主体、继承主体、经营权性质,统一司法尺度和裁判标准。In judicial practice, woodland can＇t be undertaken. Attitudes held by judges are entirely distinctive, largely depending on different interpretations of the fight of subjects, the subjects of inheritance and the nature of the right. The reason for different ruling behind the phenomenon is that the legislations are not clear or even conflict with each other. Therefore, it is unable to provide useful guidance for judicial practice. It is necessary to improve legislation, clear the woodland franchise contract＇ s subjects, the subjects of inheritance, the nature of the fight and unify justice measure and judgment standard.
