公职律师制度的本土构建之路——通过政府法制机构构建公职律师制度

摘　　要：构建公职律师制度是建设社会主义法治国家、实现国家治理能力法治化的制度化手段之一。在借鉴域外经验进行公职律师制度构建中,必须明确制度构建目标并考察已有制度能否提供相似功能,以此决定本土化构建的方式。在我国公职律师制度旨在通过国家制度内设立法律专业团体实现依法行政。目前政府法制部门与公职律师制度在目标及功能上具有高度重合性。为此应在现有法律框架下通过对政府法制机构制度进行改造优化,将公职律师制度逐步纳入其中发挥功能以实现后者的本土化构建。此路径在功能延续、制度吸纳上具有可行性和经济性,更能适应当代中国法治的需要。Constructing public-employed lawyer system is one of the important institutionalized patterns to build a socialist country under the rule of law and realize China＇s national governance capacity. The existing studies have mostly focused on the concept definition of ＂public-employed lawyer system＂, the foreign experiences and the introduction of China＇ s domestic pilot projects, but still have little discussion on its relationship with relevant governmental agencies in China, which leads to numerous problems. In the process of constructing public-employed lawyer system drawing upon overseas experience, the goal of such a system construction and the investigation of whether existing system could provide similar functions should be defined firstly, for which the way of localized construction will be made. In essence, public-employed lawyer system is aimed to achieve law-based administration by the legal professional groups belonging to the legal profession exclusively work for government and its agencies or official system. In cur- rent government system, the government legislative affairs office has provided most of the functions which the public-employed law- yer system is also expected to offer. In this context, the government legislative affairs office should be optimized and modified under the existing legal framework, and the public-employed lawyer system should be also incorporated into it gradually and function, in order to realize the latter＇s localized construction. This way is more feasible and effective in the aspects of the continuation of function and the incorporation of system, and more suitable for the needs of the rule of law in contemporary China.
