摘　　要："亲亲相隐"是中国传统伦理文化的一部分,是一项不可或缺的法律原则,对古代法律制度产生了深远影响。《刑事诉讼法》第188条规定了近亲属强制出庭作证予以豁免,该条规定让"亲亲相隐"再次引起法学界广大学者关注。针对我国目前的情况,我们可以选择性地继承,适当地完善我国当代刑事法律中亲亲相隐的制度,从而更好地实现法治。“Tolerating and Concealing between Kinfolks” is a part of Chinese traditional ethical culture, is an indispensable legal principle, made a profound impact on ancient legal system. “Criminal Procedural Law” the 188th regulation of close relatives have forced to testify exemptions from, which makes ＇tolerating and concealing between kinfolks, again legal science many scholars attention. In view of the current situation in China, we can selectively inherit, appropriate consummates our country contemporary implicit kiss phase in the system of criminal law, so as to better realize the rule of law.
