摘 要:为解决民生问题和构建和谐社会、建设小康社会,党和国家提出了以保障和改善民生为重点的社会建设战略,该战略既需要社会法制的支撑,又为社会法制发展创造了条件。在社会建设时代,与社会建设战略相匹配的社会法必然是我国法律体系中重要的独立法律部门,并应当具备从保障基本民生到全面促进社会良性运转的多层次功能。为时代条件、社会法功能目标和社会建设的需要所决定,社会法需要以原有社会保障法内容为基础进行体系重构和扩展。我国社会建设时代的社会法可包括社会救助法、社会保险法、社会保护法、社会补偿法、社会促进法五个在功能上层层递进的核心功能分支体系,以及社会基本法、社会组织法和社会公益诉讼法三个基础分支体系。In order to solve the problems concerning people's livelihood and building a harmonious society, the Party and country formulate the Social Development Plan which focus on improving the peopleg wellbeing. The Plan needs to be supported by social legal system, as well as provides conditions for its evolution. In this era, the social legal system matching with the Plan must be the independent branch of China's legal system and has multiple functions which spread from ensuring and improving the people's wellbeing to promoting the society operates virtuously. Determined by the social condition, the functions of social law and the demand of carrying out the Plan, the social law should expand it disciplines on the base of social security law to five core branch laws which consists of social assistance law, social assurance law, social protection law, social compensation law and social promotion law, as well as social basic law, social organization law and social procedural law.
