摘　　要：在我国社会转型时期,与市场经济相配套的法律规范、道德规范尚处于形成、建立和完善的过程之中,加之传统道德约束失范,致使许多违法、违德的行为没有得到应有的惩罚,而损人利己的行为却成为"最优选择",这最终让社会在一定程度上陷入了囚徒困境之中,从而阻碍了市场经济的发展。文章基于博弈的视角,提出了从外在约束到内在约束的双轨解决路径,籍此希翼我国经济社会形成广泛的合作、互助道德基础并最终发展出基于民主、法治且完善的市场经济体系。During the period of transformation of China, the market-oriented legal and moral system is still under construction. The illegal behavior benefitting oneself at the expense of others has not been punished,but becomes the optimal choice. Therefore, the society is stuck in the prisoners＇ dilemma to some degree. Based on the perspective of game theory, this paper puts forward a dual-track solution from external constraint to internal constraint, which would help to pave the way to establish socialist market economy system with Chinese characteristics on the basis of extensive win-win morality.
