摘　　要：在简要梳理中国农村宅基地使用权流转法律制度及其在实践中存在的问题,从法学角度对宅基地使用权属性、房地分离还是房地统一、法定租赁权还是法定地上权等有关宅基地使用权流转制度改革争议进行初步分析的基础上,提出农村宅基地使用权流转的规范与法律制度创新的若干构想,包括规范农村宅基地使用权的取得、转让、退出等制度,在中国物权法律制度的"法定地上权"中增设"派生宅基地使用权"。Based on the brief review of the legal and practical problems concerning the transfer of China rural land use right, the paper analyzes institutional reform argue focusing on the circulation of homestead right from the perspective of law, such as the dispute on the right to use the homestead, the argue on the separation of the real estate or the unification of the real estate, the debate about the right of the house, statutory tenancy rights or legal right of land. We propose one new idea that is to add ＂derived right to the use of curtilage＂ to the real right＇s establish system.
