摘　　要：第三方法治评估作为对内部评估的优化而得以提出,且以倒逼政府工作为初衷,然而实践结果却是日渐形式化。运用布迪厄的社会实践理论对第三方评估场域及其微观运行予以反思研究可以发现,第三方法治评估场域尚属新兴场域,且具有开放性、同构性、斗争性等特征,而在此生态环境下评估专家、行政主体、公众在行为策略的选择上均偏保守,彼此间形成制约模式。而要突破当下的实践困局,需正确认识第三方评估的性质与价值、科学界定评估受托方的权责、打破多元主体的传统惯习,并建立有效的接纳机制。As an optimization to internal assessment,the third- party evaluation of the rule of law is put forward,and purposes to prompt governments＇ work. However,the practice turned out to be increasingly formalized. With the analysis of Bourdieu＇s theory of social practice on the microscopic operation process,it is found that the evaluation field is an emerging field and features such as openness,isomorphism and belligerence. However,evaluation experts,administrative subject and public＇s behavior strategies are all conservative and restrain each other. To break through the present dilemma of the practice,we need to correctly understand the nature and value of the third- party evaluation,the Scientific definition of evaluation of entrusted responsibilities,breaking the traditional rituals of plural and form a complete set of effective mechanism of acceptance.
