摘 要:在全面深化改革和全面推进依法治国的过程中,我国政府日益意识到竞争政策在经济政策中的基础性地位。公平竞争审查制度作为推行竞争政策和约束政府权力的重要举措,在我国尚处于初建阶段。审查主体制度的设计是公平竞争审查制度建构的基础和关键。公平竞争审查主体可分为法律和政策制定机构、竞争执法机构和独立的专责审查机构。结合我国实际情况并借鉴域外先进经验,我国公平竞争审查制度的建立应遵循渐进式原则,由现阶段的政策制定机构自查和备案制模式逐步过渡到最终的一元化审查主体模式。In the process of comprehensively deepening reform and comprehensively implementing governing the country by law, our government is increasingly aware of the fundamental position of competition policy. As an important measure to implement the competition policy, the review system of fair competition is still in the initial stage of construction in China. The design of the review subject system is the foundation and key of this construction. The review subject of fair competition consists of the organizations who formulate policies, the law enforcement agencies, and the specialized censorship. Thinking of the actual situation of our country and foreign advanced experience, we should follow the principle of step by step when we establish the review subject fair competition. And we should change the review mode from self-check and recording system to simplex subject.
