关于制定民法总则的几点思考

摘　　要：民法总则是统领整个民法典并且普遍适用于民商法各个部分的基本规则。民法总则的制定,基本确立了民法典的体系安排,对于妥当协调民法总则与民法典分则的关系具有重要意义。我国民法典在体系安排上,应当以民事权利为贯穿红线,从而使各项制度成为具有内在逻辑联系的整体。民法总则应成为全面确认和保障私权的基本法,应充分彰显人文关怀的时代精神,强化对人格尊严的保护。民法总则草案对民事权利的确认和保护具有全面性、时代性和开放性。General Principles of Civil Code is to guide the whole Civil Code and generally applicable to the basic rules of the various parts of the civil and commercial law.The formulation of General Principles of Civil Code basically establishes the system arrangement of Civil Code,which is of great significance to the appropriate coordination General Principles and specific parts of Civil Code.In the system arrangement of Civil Code,civil rights should be General Principles of Civil Code should fully affirm and protect civil rights,fully demonstrate humanistic spirit of the times,and strengthen the protection of human dignity.The protection and confirmation of civil rights in General Principles of Civil Code(Draft) is comprehensive,system-developing and opening.
