摘 要:判断信赖原则如何具体地在组织型医疗体系中得以适用,这是困扰刑法理论及其实务的一道难题。论题从自由执业医师之间以及医院各科医师中的归责评价与信赖原则适用判断出发,对处于水平分工与垂直分工中不同医师之间适用信赖原则的情况予以分析,并结合涉医刑事司法实践,进一步明确相关医疗行为之客观注意义务的范畴及具体情况中客观归责之判断与信赖原则之适用的角力空间。It is a difficult problem for the theory and practice of criminal law to determine how the principle of reliance is specifically applied to the organization-type medical system. Starting from the determination of applicability of imputation assessment and reliance principle among free medical practitioners and those at different departments of a hospital, the paper analyzes the applicability of reliance principle for different practitioners who are at both horizontal and vertical division of labor. Along with the judicial practice of doctor-involving crimes, it further clarifies the demarcation between the category of objective duty of care in relevant medical behaviors as well as the judgement of objective imputation and the applicability of reliance principle.
