摘 要:以英国高等法院商业法庭2015年4月17日作出的荷兰西特福船运公司诉中国银行案判例(Spliethoff’s Bevrachtingskantoor BV v.Bank of China Limited[2015]1)为基础,探讨了船厂撇开造船合同中伦敦仲裁条款的约定,以船东和供货商合伙欺诈为由,在中国境内对船东和供货商提出索赔,并申请中国法院止付银行保函的可行性及法律效力。本案对中国船厂及中国商业银行处理类似问题具有重要的指导意义。Based on the case of"Spliethoff's Bevrachtingskantoor BV v. Bank of China Limited[2015]EWHC 999",as ruled by the English High Court on April 17 of 2015,this paper discusses the feasibility and legal force for the builder's claim for loss in China from the shipowner and engine supplier and its application to a Chinese court for an injunction to prohibit payment of the bank guarantee,disregarding the London arbitration clause in the shipbuilding contract,on the grounds that the shipowner and engine supplier conducted fraud together. This case has great significance for Chinese shipyards as well as commercial banks to handle similar issues.
