论我国的离婚救济制度

摘　　要：离婚救济制度是法律从公平正义的立场出发,为离婚过程中夫妻受损害或者处于弱势的一方提供的权利救济方式或者法律救助手段。我国的离婚救济制度深受中国传统伦理的影响,在救济措施方面闪烁着中国古代婚姻家庭的优秀思想的光辉,为我国家庭婚姻关系顺利解除以及保障社会关系的和谐提供必要支持。同时,我们不可忽视其在现代社会中也有不足之处,包括制度设计没有充分考虑社会现实,以及作为上层建筑的婚姻救济制度已经不能够解决当下的现实问题。因此,探讨离婚救济制度的完善和发展对我国婚姻家庭法的完善具有重要意义。Based on legal justice, the divorce relief system offers right relief and legal aid to the victim or the disadvantageous party at the time of divorce. China＇s divorce relief system is deeply influenced by traditional ethics, so the relief measures reflect ancient thoughts of marriage and family in China, providing the necessary support for the relationship between family and marriage and ensuring the harmony of social relations. However, we cannot neglect shortcomings in the modern society, and its system design didn＇t consider the social reality, and great changes in the social life. As a result, the marriage relief system as the superstructure cannot solve practical problems at present. Therefore it makes sense to explore development and perfection of the divorce relief system in perfecting China＇s Marriage Law.
