绿色化背景下我国环境立法的困境与出路

摘　　要：环境立法作为环境法治的重要组成部分,其实施和贯彻对于环境法治的发展具有重要的影响,并且在较大程度上影响着我国环境法治对于实现绿色化的整体效果。但在绿色化背景下我国环境立法工作仍存在一定的困境,为此,我国环境立法应该树立绿色化的立法理念,调整环境立法目的,发展协调有序的立法保障机制,通过环境立法贯彻公众参与原则。Environmental legislation is an important part of environmental rule of law,whose implementation influences significantly the development of environmental law and,to a large extent,the overall effect of China＇s environment rule of law on greenness realization.However,under the background of greenness,China＇s environmental legislation still faces some dilemmas.Therefore,China＇s environmental legislation should establish the concept of green legislation,adjust the aims of environmental legislation,develop a coordinated and orderly legislative safeguard mechanism,and implement the principle of public participation through environmental legislation.
