摘 要:研究目的:为我国农村土地证券化的深入研究提供参考,为进一步推进我国农村土地证券化提供现实指导。研究方法:在分析德国、美国、日本这三个国外典型农村土地证券化产生背景及运行机制的基础上,将其三者进行比较研究并总结经验。研究结果:(1)完整清晰的农村土地产权是农村土地证券化的前提;(2)政府的支持是农村土地证券化的保证;(3)农村信用合作组织是农村土地证券化的基础;(4)专业和健全的法律法规是农村土地证券化的保障。研究结论:我国对农村土地证券化的探索和实践仍然处于零星状态,有必要在借鉴国外经验的基础上建立农村土地证券化试点,从现实中验证农村土地证券化的可行性。The purpose of this study is to provide a reference for the further study of rural land securitization in our country, and to further promote our country rural land securitization provides practical guidance. Based on the analysis of Germany, United States, Japan, the three typical foreign countries rural land securitization operation mechanism to sum up experience. The study showed that 1) Complete rural land property rights is the precondition of rural land seeuritization; 2) Government support is the guarantee of rural land seeuritization; 5) Rural credit cooperative organizations can promote the unitary use of rural land; 4) Professional laws and regulations are the guarantee of rural land securitization. This paper draws conclusions that the exploration and practice on rural land seeuritization in our country is still in an explored state, it is necessary to verify the feasibility through pilot areas and then formalize the rural land seeuritization in China learn from foreign experience.
