摘　　要：大数据时代的个人信息用于识别信息主体,宜将其作为人格保护,并充分认识其具备精神利益与物质利益双重属性。网络消费者个人信息权的权能主要有管理权、许可使用权、收益权。对网络消费者个人信息的侵权依行为表现区分为第三方窃取,信息管理者非法收集、泄露、不当保留,非法交易,侵扰式利用等。利用个人信息衍生的侵权行为依侵害客体属性区别对待。在我国现行法律规范下,民事救济可采用加害人承担单方侵权责任、网络侵权共同责任,有约定的,信息主体可选择主张违约责任;亦可采用刑事救济,或由信息化、电信、工商部门进行行政监管。Under big data era, personal information is used for identifying the information subject, it should be protected as independent personality. Understanding the attributes of spiritual interests and material interests of its personality is important. The consumer＇s personal information rights include management rights, the right to use license and usufruct. According to the act performance, the infringement should be divided into theft from third party, or illegal collection, leakage, improper retention by data manager, or illegal transactions, disturbing use, etc. The infringement consequent upon use of personal data should be distinguished on the basis of attributes of infringed object. Under the frame of active law and regulations of P. R. C, the civil remedies could be used, the perpetrators should bear unilateral or common tor~ liability. Where an agreement is entered into, as a choice, the subject of personal data should urge the responsibility for breach of contract. The criminal remedies could also be used, or the authorities relevant to information, telecommunications, industrial and commercial administration have power to carry out administrative supervision.
