摘 要:中国土地所有权性质的不同使得房屋征收形成了特有的二元制结构,集体土地上房屋征收补偿在实践中以《物权法》《土管法》等法律作为主要依据已不能满足现实需要。文章通过对2011-2015年贵州省高级人民法院受理的集体土地征收补偿180件二审行政案件的案由、特点、裁判理由和结果进行分析,归纳出集体土地上房屋征收补偿实施中存在的不足,指出行政机关征收执法过程中存在的主要问题,并提出集体土地上房屋征收补偿法治化建构中立法完善、规范执法、强化司法的路径和重点。There is a unique binary system structure of China' s collective land expropriation compensation and compensation for housing because of China' s land ownership. It cannot satisfy the need of reality for the collective land on the housing expropriation and compensation in practice to Real Rights Law and Land Administration Law.This article will sum up the problems exist in the implementation of the collective land on the housing expropriation and compensation, point out main problems exist in the process of law enforcement by administrative expropriation,and put forward the collective land on the housing expropriation and compensation of the rule of law in the construction of legislation, law enforcement, and strengthen the judicial path by analyzing 180 cases in Guizhou Province Higher People' s court from 2011 to 2015.
