摘 要:持久性有机污染物(POPs)对环境和人类危害极大,在国际层面主要通过《斯德哥尔摩公约》对其进行规制。中国作为公约的缔约国,存在POPs管理法律体系不完善、POPs排放标准制度不健全、污染损害追责赔偿制度缺位等不足。比较而言,发达国家建立了较为完备的POPs减排制度,取得了较好效果。为此,需要探寻中国履约减排的法律制度缺陷的原因,借鉴国外相关立法和制度实践的优点,以便建立和健全履约协调减排机制、POPs排放标准制度和POPs污染责任保险制度等,这既是对《斯德哥尔摩公约》的践约行为,也可为中国日益严重的持久性有机物污染的治理提供有力的保障。The Persistent Organic Pollutants(POPs)is of great harm to natural environment and human health.To regulate the POPs internationally,Stockholm Convention on Persistent Organic Pollutants was signed.China is a state member to the Convention,and it shall comply with the provisions of the Convention.However,deficiencies exist in its POPs management legal system,POPs environmental standard system,and pollution damage compensation system.Comparatively,the developed countries have established a relatively complete POPs emission reduction system,and achieved good results.Therefore it is necessary to search for the defects of the laws and regulations on the performance of emission reduction in China and make full use of advances of laws and regulations in foreign countries in-depth,so as to put forward constructive suggestions,including establishment of the coordinating emission reduction mechanism,improvement of the POPs emission standards,and establishing the POPs pollution liability insurance system for implementation of Stockholm Convention,and it also provides strong support for soil pollution control in China.
