我国人民法院创新社会管理的司法法治逻辑考量

摘　　要：我国人民法院创新社会管理是转型社会司法权运行机理的内在要求,多维视域的理论关切为创新社会管理诠释出复杂而又鲜明的技术识别差异以及提供可靠的智识来源。但实践样态中各级人民法院创新社会管理呈现出模仿性、随意性和扩张性倾向。司法职业伦理在三个维度,即转型社会的的客观诉求、司法面向的现实追问和智识技术的识别来源,为我国人民法院创新社会管理明晰司法法治逻辑的具体实现路径,其应遵循法治建构的普遍性规制。The innovation of social management in the people＇s court is the inherent requirement of social judicial power operation mechanism of transformation. Multidimensional horizon theory of the concern for the innovation of social management in the complex and distinctive technology to identify differences and provide a reliable source of knowledge. But the form of innovation of social management practice in various levels people＇s courts presents a copycat, randomness and expansionary tendency. Judicial professional eth- ics in three dimensions, namely objective demands of transformational society, realistic questions of justice facing and identify sources of technical knowledge, clear implementation path of judicial logic the rule of law about the innovation of social management in the people＇s court, and it should follow the general regu- lation of the rule of law construction.
